Rental contract Jet ski

1.- Hereby, SKAMA JET S.L. with CIF B55493845, rents to the undersigned lessee, the Water Jet / Jet ski with registration number, date and duration of rental agreed and expressed below, subject to the “Nautical Rules” and the following;

TERMS AND CONDITIONS OF THE RENTAL.

2 .- The purpose of this lease is exclusively for the use of the jet ski for the use of the same route or journey organized and guided by specialized staff of the leasing company, without any concept that the lessee can move by itself not following another itinerary that is determined by the lessor.

3 .- The lessee agrees to strictly follow the conditions and nautical rules, in addition to those contained herein and declares to know, as well as the instructions given at all times by the authorized personnel and accompanying the lessor. Otherwise the lessor or authorized person and companion during the voyage may terminate this lease.

SKAMA JET S.L. will make available to the lessee(s) the Water Jet / Jet ski indicated in the present contract during the agreed time, being the lessee obliged to return it at the agreed time and date, and in the same place of delivery.

5 .- In the event that the lessee does not return the boat, without prior notice and agreement to extend the contract by SKAMA JET S.L., it will be understood the intention of theft by the lessee, and SKAMA JET S.L., reserves the right, without the need for any other procedure, to proceed judicially if it deems necessary. All the litigations that could exist, will be exclusively competence of the courts of Ibiza.

6.- The lessee shall inform the lessor as soon as possible of any damage or incident that affects or may affect the seaworthiness or safety of the Water Jet / Jet ski during the lease.

7.- SKAMA JET S.L.. reserves the right to recover the Water Jet / Jet ski at any time during the lease if its use contravenes the provisions of this contract, if the instructions of the monitor are ignored, or if it is misused.

8.- The lessee is obliged not to leave the Water Jet / Jet ski unattended at any time during the lease.

To the extent authorized by law, SKAMA JET S.L., shall not be liable for damages suffered by the lessee or third parties due to the use and operation of the Water Jet / Jet ski, nor for loss or damage to property of the lessee or third parties, for possible breakdown of the engine or other cause; and the lessee releases SKAMA JET S.L. from any damage or liability in this respect.

10.- The lessee shall be responsible both civilly and criminally for any liability that may arise from the use of the rented Water Jet / Jet ski.

11 .- It is strictly forbidden for a minor to perform the activity with another minor, being the full responsibility of the parents or legal guardian, to provide accurate data of minors, and also being the full responsibility of the parents or legal guardian any damage or accident caused by the realization of this activity.

NAUTICAL RULES

1. The renter must be at least 18 years old, or if older than 16 years old, the father, mother or legal guardian, sign the authorization for minors, know how to swim, not be under the influence of alcoholic beverages or other intoxicating substances, have read and understood all the forms, terms and conditions of this contract, and have understood and respected the instructions given by the lessor or monitor, before the departure of the Water Jet / Jet ski.
2. During the navigation you must go one bike behind the other, keeping a row of 1, a minimum of 25 meters between bikes, and always behind the monitor throughout the tour. The minimum distance from other boats will be 100m. The renter/s is/are obliged to follow at all times the route, speed or other orders and indications given by the monitor.
3. You can not come within 50 meters of another motorcycle, floating device, ships or boats, bathers or divers buoys and should avoid the area of anchored vessels.
4. The speed within ports, canals, entrances and exits, in areas near rocks or bathers, or in areas with anchored vessels, shall be a maximum of 3 knots.
5. It is totally forbidden to make closed circles during navigation.
6. It is necessary to stay 200m from the beach or coastline, or areas set aside for bathers.
7. The maximum number of passengers per jet ski is 2 people, with a minimum height of 1'10m, and a minimum age of 10 years old to ride as a passenger on the jet ski.

8. In case of taking a minor as a passenger, it is mandatory to be accompanied by an adult, who will be responsible for any incident, accident or damage caused to third parties, and to have or sign the explicit authorization of the parents or legal guardians.

I also hereby declare that I know and agree to the practice of this sport, that I am fully aware that the physical activity I perform is risky and known as extreme sport and as such involves constant physical risks. I assume full responsibility for what may happen while practicing this sport, both to myself and to third parties for my performance. I assume the responsibility that the development of this sport exposes me to inherent risks that may result in every occasion that I practice it. In case I do not respect the rules informed by the instructor or employee of SKAMA JET S.L., I may be forced to stop the practice and I may be removed from the place. The undersigned (and/or his/her parent/guardian) agrees to release the instructor and the company SKAMA JET S.L.. from any responsibility for possible accidents, and from any damage or liability in this regard as a result of the practice of this sport.

I declare to be in full mental capacity to contract and to be obliged to comply with all the points of this contract, and to have understood all the explanations, indications and necessary rules for the practice of this sport discipline previously given by the monitor or worker of SKAMA JET S.L.. and to be in psycho-physical conditions suitable for the practice of this sport, as well as equipped in conditions for the practice of this sport.
